WorkComposer Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs use of the websites, applications, and related services (the “Services”) provided by WorkComposer Inc (“WorkComposer”, “we”, “us”, or “our”). It is incorporated into and part of our Terms & Conditions of Service (“Terms”). Capitalized terms not defined here have the meanings given in the Terms.
This AUP applies to the Customer, its Authorized Users, and anyone accessing the Services through the Customer's account. The Customer is responsible for ensuring its Authorized Users comply with this AUP.
1. General Rule
You may use the Services only for lawful business purposes and in compliance with this AUP, the Terms, and all applicable laws. You must not use the Services in any way that harms WorkComposer, our users, or any third party.
2. Prohibited Uses
You must not, and must not permit any Authorized User or third party to:
2.1 Unlawful use
- Use the Services in violation of any applicable law or regulation, or to facilitate any illegal activity.
- Infringe or misappropriate any intellectual property, privacy, publicity, or other right of any person.
2.2 Unlawful or improper monitoring
- Use the Services to monitor any individual without a valid legal basis and without providing all notices and obtaining all consents required by applicable law (including employee/worker notice and consent requirements, works-council or employee-representative obligations, and U.S. federal and state electronic-monitoring notice and wiretap laws). Establishing a lawful basis and giving required notice is the Customer's responsibility as Controller, as set out in Section 3 of the Terms.
- Use the Services to monitor individuals outside a lawful employment or contractor relationship, including for personal, domestic, stalking, harassing, or surveillance purposes unrelated to legitimate workforce management.
- Deploy the desktop application to devices you are not authorized to monitor, or disable or tamper with the notice surfaces the Services provide to Monitored Users.
2.3 Security and integrity
- Attempt to gain unauthorized access to the Services, other accounts, or any systems or networks connected to the Services.
- Probe, scan, or test the vulnerability of the Services, or breach or circumvent any security or authentication measure, except under an authorized, written security-testing arrangement with us.
- Introduce or transmit any malware, virus, worm, rootkit, spyware, keystroke logger, or other harmful code.
- Interfere with or disrupt the integrity or performance of the Services, including through denial-of-service attacks or excessive automated requests.
2.4 Reverse engineering and misuse of the software
- Copy, modify, translate, or create derivative works of the Services, except as expressly permitted.
- Disassemble, decompile, or reverse-engineer the Services, or attempt to derive source code, except to the extent this restriction is prohibited by applicable law.
- Resell, sublicense, rent, lease, or provide the Services to third parties except as expressly permitted, or remove or obscure any proprietary notices.
- Use the Services to build a competing product or to benchmark for a competitor without our prior written consent.
2.5 Abuse and objectionable content
- Upload, store, or transmit content that is unlawful, defamatory, harassing, threatening, obscene, or otherwise objectionable, or that you do not have the right to provide.
- Use the Services to send spam or unsolicited communications, or to impersonate any person or misrepresent your affiliation.
- Use the Services in a way that imposes an unreasonable or disproportionately large load on our infrastructure, or that circumvents usage limits, license restrictions, or billing.
3. Customer Responsibility
The Customer is responsible for all activity conducted through its account and for its Authorized Users' and Monitored Users' compliance with this AUP. The Customer must promptly notify us of any known or suspected violation or security incident at support@workcomposer.com.
4. Enforcement and Consequences
- issue a warning or request corrective action;
- suspend or throttle access to the Services, in whole or in part;
- remove or disable offending content or configurations;
- terminate the account under the Terms; and/or
- report the matter to law enforcement or cooperate with authorities where required or appropriate.
Where practical, and except in cases involving an active security or legal risk, an ongoing violation, or a legal requirement, we will attempt to give notice before suspending or terminating. We are not liable for any action taken in good-faith enforcement of this AUP, and enforcement does not entitle the Customer to any refund (see Section 7 of the Terms).

6. Changes to This AUP
We may update this AUP from time to time. We will post the updated version with a revised “Last updated” date. Continued use of the Services after an update constitutes acceptance.
